Lord Carloway, formerly of the SFA Judicial Panel (And Much Else), Appointed Lord Justice Clerk

Lord Carloway QC has been appointed by the Queen to be the new Lord Justice Clerk. He replaces Lord Gill who was recently appointed as the new Lord President.

Lord Carloway was nominated by the First Minister taking account of recommendations made by an independent selection panel.

Lord Carloway was appointed a Judge in February 2000 and was appointed to the Second Division of the Inner House in August 2008. He was admitted to the Faculty of Advocates in 1977 and was appointed Queen’s Counsel in 1990. Continue reading

Carloway and Graham Step Down from SFA/Rangers Tribunal – + Breaking – SFA Statement re Embargo

Michael Grant of the Herald reports today the two of the three members of the SFA Appellate Tribunal which confirmed the sanctions on Rangers before being overturned by the Court of Session have stepped down.

Lord Carloway and Craig Graham, the chairman of Spartans, will be replaced if or when the SFA’s Appellate Tribunal reconvenes to consider the transfer ban again.

Herald Sport understands that Lord Carloway was unhappy that his verdict was contradicted by another judge and wrote to the SFA to inform them he would no longer be available for any future cases. Graham cannot consider the case again because of the possibility that suspending or expelling the oldco Rangers’ SFA membership (which the newco club seeks to take over) could create a vacant league place for which his own club, Spartans, could seek to apply. Graham removed himself rather than face a conflict of interest although he will remain available to the SFA for future cases.

Rangers FC are Ineligible to Play in the Scottish Cup, But SFA Has Included Them Anyway

In which I meander round the Rules of the Scottish Cup and look at some questions.

Why is Rangers FC ineligible for the Cup? Despite that the SFA have them included – pre-judging issues or an oversight?

Does the competition start when the draw is made or when the first match is played? This matters.

What round would an SFL3 Rangers enter the Cup in? It is not clear.

Can the Appellate Tribunal eject Rangers from this year’s Cup before the Preliminary Round takes place, or must it wait till after 4th August to have that option available?

When the SFA disciplinary processes were ongoing earlier this year, and when Lord Glennie overturned the registration embargo, there was discussion about the possible alternative penalties which could be imposed.

Will the SFA Approve Transfer of Rangers’ Membership to Sevco Scotland Ltd?

In which I look at what Sevco Scotland still have to do to get their team actually out onto a playing field. The main issue now is the SFA membership transfer.

However, there are various issues which suggest that this might not be a formality, and indeed that it ought not to be.

I look at what the status of the existing membership, held by Rangers Football Club PLC (In administration) is, and whether, with the new “fit and proper person” rules, it can actually be transferred to Sevco at all!

Can it be transferred whilst the various disciplinary matters are still to be determined? Should it be?

Why has there been such a delay by the SFA in dealing with this and the re-establishment of the Appellate Tribunal?

And finally, what has this picture got to do with the leadership shown by the SFA and SPL?

Charles Green “Over Next 7 Days, All the Questions will be Answered”. Here are Some for Sevco Rangers

Mr Green has promised answers to “all the questions” within seven days. I have suggested a few for him to respond to.

I also note he talks about what happens “if” the Appellate Tribunal re-convenes. I wonder of the SFA will announce soon what is happening with that. I am sure Lord Carloway has a summer holiday to go on!

It also seems to be the case, although this is not a surprise of course, that in Mr Green’s mind “the good of Scottish football” = the preservation of “Rangers”.
