This is a succesful appeal decided by the Lord Justice General, and Lords Eassie and Brodie.

On 7 April 2006, after a trial lasting over 5 weeks, the appellant was convicted of the following- “on various occasions between 14 October 1982 and 20 December 1982 both dates inclusive, at [various locations in Edinburgh] you did assault J.S., born 14 May 1982, now deceased…and did cause her upper airways to be obstructed by means unknown, restrict her breathing, all to the danger of her life; and (2) on 20 December 1982 at [a location in Edinburgh] you did assault J.S., born 14 May 1982, residing there, and did obstruct her upper airways by means unknown, restrict her breathing, suffocate her and kill her”. The deceased was the appellant’s daughter.

The case was referred to the High Court in 2010 by the Scottish Criminal CAses Review Commission.

In the appeal it was stated inter alia (1) that the trial judge had misdirected the jury by failing to set out for them the expert evidence which they would require to accept in order to convict and (2) that in the circumstances of this case there was an infringement of the appellant’s right under Article 6(1) of the European Convention to a reasoned judgment.

The child who died was seven months old at the time of her death. Prior to her death, she had attended hospital on a number of occasions having had what the appellant described as “turns”.

There was no direct evidence that on any occasion the appellant had assaulted the child. The Crown case at trial turned substantially on medical inferences that the child had on each occasion, including the last which led to her death, been subjected to deliberate obstruction of her airways.

The Court went at some length through the numerous medical experts who had given evidence on either side.

The appellant’s primary ground of appeal was that there had been misdirection by the trial judge. It was submitted that, standing the complex nature of the case and the divergence in the expert opinion, the trial judge ought to have analysed the evidence in greater detail and offered more guidance to the jury. A number of English authorities provided helpful guidance. In complex cases directions should provide structure, focussing the issues and any material disputes which had to be resolved: one could not rely on the speeches of counsel. The requirements of a fair trial demanded that a jury’s decision be reached on a logically justifiable basis. Thus, in cases involving expert medical evidence, they should, where relevant, be directed on the need before convicting to reject any realistic alternative explanation for the cause of death and on the need for caution in relation to developing medical science. An analogy could be drawn with the trial judge’s duty, in ensuring a fair trial, to give legal directions independently of the manner in which parties presented their case.

In an associated ground of appeal it was submitted that, in the circumstances of the present case, the failure of the jury to provide reasons for their decision had denied the appellant a fair trial in terms of article 6 of the European Convention on Human Rights.

The Crown opposed the appeal. It was submitted that there had been no mis-direction, although accepted that if there had been then there would have been a miscarriage of justice. There might be cases in which it was incumbent upon a trial judge to give specific directions, but that was not so in the present case. While it had involved a number of experts, they had given evidence over five weeks and that evidence had been tested by senior counsel, who had then addressed the jury: in the circumstances there had been ample opportunity for the exposition of the material issues which had to be resolved. Indeed, in a complex case it was often counter-productive for a trial judge to revisit the evidence or focus on particular points; to do so could complicate matters and distract a jury’s focus from other relevant evidence.

In relation to article 6, in the present case, the evidence had been heard in public, recorded and rigorously cross-examined. The indictment made clear the facts which had to be proved and the jury were aware that the onus lay on the Crown in that regard. Moreover, the right of appeal ensured due consideration that there had been a logically justifiable basis for the verdict returned. In all of the circumstances it could not be said that the appellant had been denied a fair trial.

Their Lordships considered the matter, starting with the comments of Lord McCluskey in Shepherd v HM Advocate 1996 SCCR 679.

They then said “Cases involving the deaths of infants allegedly at the hands of a parent or other carer are amongst the most difficult, and potentially the most complex, of all cases coming before the criminal courts. In many such cases, and the present is such, there will be no direct evidence of criminal conduct by the accused towards the child. The case will largely, if not exclusively, depend on inferences to be drawn from medical testimony. In this field, while knowledge advances, there remain many uncertainties. Establishing the cause of a sudden infant death may be very difficult and in some cases may not be possible. If criminal liability is to be brought home to the accused it will be necessary to exclude not only any natural explanations for the death suggested in the evidence, but also any realistic possibility of there being an unknown cause.”

“Where there is on the evidence a realistic possibility of there being an unknown (currently unknowable) cause of death, as there was on Professor Morris’ evidence, the jury should be reminded that this must be excluded before they can convict. Also, of course, the jury will require, before they can convict, to exclude any natural cause of death which is positively suggested in the evidence. This may be obvious, but the jury should be reminded of it. The way in which a jury approaches its deliberations upon the issues before it will be a matter, ultimately, for them to decide; but in a case of the present kind it will be incumbent on the judge to give them guidance. Even where counsel for the prosecution and for the defence have in their speeches fully explored the technical evidence (and they did not do so here), it will be for the trial judge to provide a succinct, balanced review of the central factual matters for the jury’s determination. Where natural causes for the death are suggested in evidence, an appropriate starting point may be to remind the jury what these are, giving a brief explanation of the evidential basis for each of them, and directing them that, if they are persuaded of them or if any evidence with respect to them gives rise to a reasonable doubt about the accused’s guilt, they are bound to acquit. ”

The Court commented that the numerous medical experts had produced a variety of different explanations for the death. It was for the Crown to establish beyond reasonable doubt that the actings of the Appellant were responsible for the death. In view of the competing and innocent explanations from the Appellant’s experts, the Court saw that it was for the trial judge to assist as far as possible with jury’s assessment of the evidence. “The task which it was, in our view, incumbent on the trial judge to perform was not an easy one. There was a risk that, in seeking to identify the position of each of the principal experts, errors might be made. But the fact that the task was difficult does not mean that it was unnecessary. The failure to undertake that task in this case amounted in our view to a material misdirection. It is not disputed that, if we came to that view, the result was that there had been a miscarriage of justice and that the verdict would require to be quashed. We accordingly allow the appeal and quash the verdict.”

The Court did not therefore need to rule on whether the jury required to give reasons for the verdict but they repeated that, in the Scottish system, there is no need for a jury to explain its verdict. However, “it is central to these decisions that the jury’s verdict is not given in isolation but in a framework which includes the presiding judge’s charge to the jury. It accordingly follows that, if in the circumstances of the particular case that aspect of the framework is materially inadequate, the verdict may be vulnerable to challenge under Article 6.” If called upon to do so in this case, they would have found that the failure to direct the jury regarding the technical evidence would have infringed the Appellant’s right to a fair trial.

This case shows the challenges faced by the courts in complex and technical cases. Counsel at the trail did not, in any detail, go through the expert evidence so as not to misinterpret it for the jury. The trial judge clearly felt the same. Appeals can arise where a judge does review the evidence, and one party feels that this has not been done fairly.

However, in a  case of this complexity and importance, one can see clearly why it was felt that the jury ought to have been given as much guidance as possible.

One can only feel for the appellant, convicted 24 years later of killing her child and now with her conviction quashed. One wonders what action the appellant might now take.

      I floated the idea of meeting up with anyone interested in a new blog after the funeral. As there was no indication of any interest I attended the funeral purely in respect to Paul. I realise now that some might have felt that I was being ‘crass’ or disrespectful to Paul.[ certainly having a budweiser beer label stuck on my jacket would have been!]
      I have no idea how to connect with people or organise a new blog, or indeed whether that is what people want.
      On TSFM people seem to be able to PM [ privately mail ] each other. Perhaps ,if anyone is interested,[ and I note a few of our regular posters are on TSFM ] then something could be sorted .

    hi fra and all am laying the foundations of a new blog now a got your comment and others a have enlisted the help of a young celt wizzkid to get it up and running the post content will be no near as good as pauls but what it will give us is a place to swap news and chat on developments a have a new post up today at some point and will copy and paste it when up every1 is welcome at it although it will be celtic minded as its aim is to post the truth as well as lots of lol at sevco

Gort had reservations about dcotw being impartial and having details about posters. Why would anyone ,especially from a non ‘ celtic minded republican’ background, supply you with their details ? Even more so when some of the first few replies talk about huns coming on board and you brag about being the ‘mod’!
      You have obviously gone to some trouble to set up a blog, so I wish you and your friends well, but I personally find it to be so far removed from Paul’s blog that I’m afraid I must say ” sorry, It’s not for me”.

          Agreed Ray,the usual suspects are Ready to continue the party but the host has left.
          There is a huge void left that cannot be filled.The conveyor belt that delivered fresh bait for the hounds to chase has lost its master baker(howzat for mixed metaphors!).
          The troops who are desperate to get their tuppence worth in about the Gers will have to check their coats in at the other ballrooms.Phil MacG and TSFM both have rubbish DJ’s, mad Leggo doesn’t do feedback,Bill McMurdo has a strict dress code and the other sites play punk music rather badly.
          Paul’s Plaza is no more and my dancing shoes are being hung up,no more moonies wi Maggie,jigs with Johnbhoy,tangos with Ted and hokey cokeys with wee Peter Kearney.
          Mick’s Bampots site will hopefully attract some like minded craicsters and Mick can begin a whole new career!
          Now that this laptop loyalist has no more melons to twist, the beautiful Morag has warned me not to start any of my pish with her.
          Cold turkey not being an option,i have made contact with an Amazonian tribe and we are up to our knees in tales of Vatican atrocities, and they have kindly offered to shrink the heads of any GCC cooncillors and Lord Provosts that i choose.

          Paul once mentioned a book that he may have been working on.I don’t know if he was being serious, but if any of his friends were capable they could perhaps look into that as a lasting tribute to a very funny guy.
          The harsh realities of life mean that a family are without a provider and young kids looking forward to university could use assistance towards that aim.
          So if any McConvillites have the talent and know-how,then the material is all there.

          Couldn’t agree more. However, the blog had descended into chaos latterly. Probably due to paul’s ever increasing committments ie back at work [increasing pressure] speaking engagements [ he was in blantyre fri before he died ] increase in site moderation duties [ due to increasing comments].
          Comments were all over the place; there was little or no moderation- some of that seemingly haphazard. The site must have seemed like an anchor round his neck at times .

I personally don’t want involved in any way but I will help get it up and running and advise on technicalities, if you want to go ahead and do that?           JohnBhoy and others might have family/work/other committments and can’t spare the time at the moment. My own thoughts were for three or four [ or more if practicable ] people running the site. My problem is I am a bit of a luddite – I first posted on the internet on Paul’s blog about 18 months ago -so not particularily computer savvy, if you know what I mean.
          However, I would like to get something going and would happily stand down when it is up and running if required. I agree there are plenty of good capable candidates and note your reply to mick re cam. cam imo [ wee smiley] probably posted more comments and generated more replies than any other poster on Paul’s blog and would well deffo be an asset – along with so many others.
          So gort, what do you think is the best way forward ? How do we communicate anonymously ? My daughter says create a @hotmail account and go from there. Suggestions?

            Cam is more likely to come along if he thinks he’s unwelcome. That’s what inspired him to be the most prolific poster here…

            I’ll leave the involvement of others to you and think it’s a good idea…. 3 or 4 of you getting into it is going to make things a lot easier and maybe you can have turns each of doing feature articles.

            I see that johnbhoy has a new blog all set up and it looks good. It would have been good to get him involved. Do you have the means to contact johnbhoy on tsfm or anywhere and maybe you could ask him? Maybe Hector and Fra would help?

            Either way, I’ll set up a new email account and suggest you do likewise. If you tell me what you want to call the blog, sticking to the format, I can go ahead and set that up once you give me the nod.

            Once it’s up and running you can start familiarising yourself with the controls etc…. It’s pretty simple and you’ll pick it up in no time. I’ll be here for a week or so, if you get stuck.

            We all agree that this new site could never be a replacement for Paul McConville’s. But I think there is huge demand for a site that facilitates free and intelligent discussion on a variety of subjects. In 3 months, I expect it will be a well known and valued port of call.

There are umpteen sites that espouse the same ideals. In the same way that I wouldn’t participate on follow follow or other such blogs I won’t participate in yours. However I really do wish you all the best [ at least you are trying something!]
          ps.
          A wee bit of advice if I may. At the first sign of criticism , try not to respond by calling people a fanny – even if they are obviously an irritating twat.lol.

          Anyway, I don’t see what is enigmatic about me. I think he was wrong about that, but he could have said more and I’m glad he didn’t…

          As for the new forum, I feel slightly responsible for discouraging DCOTW and I know there are several people who want a new forum. I have no real interest in it, although I probably would visit and occasionally post.

          I’m happy to admit that I miss Paul McConville, his posts, and some of the discussions that he generated. And I realise now more than ever that nobody is ever going to replace all that or even come close.

          Probably seems cold, but I like to wonder what some of the more regular posters are now putting their time into. That includes you and I thank you for the update.

          If there’s one silver lining in all this, it’s that people like you have been forced to invest time and effort into other things; I like to think that investment and those other things will be more fruitful for you than the bitter harvest you reaped here.

        I hope this posts ends up in the correct position. I would ask all to hold fire on Micks blog monitor it and judge it a few months down the road. The blog we are on got no comments early on and went on to become somthing special. Micks blog will either grow ,mature and become a success or wither and die but dont strangle it at birth please. I was willing to give DCOTW a try if he was the one to produce a new forum. No one is forcing anyone to join Micks blog but I reckon our late host would have liked you to approach it with an open mind and give it a chance.

      Lol. I had a look, mick. I wish you well with it. I would have posted but I didn’t have an appetite for any of the subjects.

      I have some suggestions;

      1) sort out the design and layout – it looks shadey and doesn’t fill the screen on an ipad. You can download new themes etc for free so you should have no trouble changing it.

      2) try and at least pretend you are impartial. Sevco and Sevco fans hate impartial because it hints at objective reality which for obvious reasons (in objective reality Rangers died) they can’t stand. Worked for me eh. Anyway, it’s all too easy for them to dismiss you if you are openly biased and have an Irish flag like that…

      3) try and eat more fruit and veg’.

      4) put your name down ASAP for counselling on the NHS. The usual wait is abut 6 months so if you get your name down now, planning ahead, by the time the blog and everything starts getting to you you might be glad you done that.

      5) learn how to edit the posts of people you don’t like so as to make them look like pricks. Looking at some of the stuff cam, steer, DCOTW, clarkeng, and others posted on here, I’m pretty sure even Paul McConville was doing that, it’s standard procedure.

            Does the site require a legal disclaimer regards hardcore loons posting offensive material? The moderation side could become a headache if folk let their emotions get the better of themselves.
            Only now can people realise the effort and commitment it takes to run a blog like Paul’s.
            It is very easy to pop in every now and then and comment,but much more difficult to construct a viewpoint and put it up to be shot at.
            I think quite a few old regulars are experiencing the various stages of grief over the loss of their “local”
            I would like to thank Paul McConville for his unique cyber therapy room and we should all take a leaf out of his book as a mark of respect.

    Gort, apologies for not replying earlier to your proposal that I continue where Paul left off and create a new blog – I was waiting until after Paul’s funeral before responding.

    The idea of a new blog has appeal but I agree with Cam (did I just write that lol?). Paul was a class act and any new blog would be a pale substitute. I gave your request serious consideration, even to the extent of creating a prototype: http://rtrpf.wordpress.com. In a respectful nod to Paul it was titled Random Thoughts Re Planet Fitba. Left it as a shell with no content. Here are my reasons for progressing no further:

    – Not least because no one can fill Paul’s big boots.
    – I am not impartial. I am a Celtic supporter and cannot pretend otherwise.
    – It is one thing submitting a post at leisure for Paul to post but quite another to be responsible for maintaining a blog’s tempo, week in, week out. That requires commitment.
    – I do not possess Paul’s benevolence or patience. I would be banishing posters to the sidelines for a week for the offence of swearing or less. Things would get so ludicrous that I would end up yellow/red-carding myself.
    – Others have already created blogs: mick and DavieCOTW (Davie, where’s your blog?). What’s another blog going to bring to the table?

    Have a nice Xmas everyone and give a thought to Paul’s family.

    • Hi Johnbhoy… My blog got no further than your own did. I designed the layout and named it – Off The Record -Random Rants. I did a memorial to Paul in the midst of the debate a new blog and whether to take it forward. While not realising that it could be accessed within” WordPress, if you publish it instead of saving it as draft. Other than that it is also just an empty shell. I decided to drop it for pretty much the same reasons as yourself. I’ve been to Mick’s site hoping to catch up with a few of the people from Paul’s site, however I don’t think i’ll be visiting regularly. It appears most of the old guard have decided to hang up their electronic quills for the time being. I’ll monitor it to see if the others come back over time, as it is still early days.         Gort, I honestly don’t have the time, ability or know-how to monitor a blog. I wish I did on all counts. One of the things about Paul’s blog was, even in the midst of provocation, Paul could slice the legs from under them without being nasty. It left the perpetrator looking foolish, but in a nice sort of way.

        If I could be of assistance, I would most definitely raise my hand but in what capacity, I do not know. Bud & Fra… (Sounds like a pair of comedians already. Haha).

        Mick has put his head up above the parapet and that has to be commended but I cannot possibly see bloggers from a non-Celtic/Irish persuasion taking part. It’s early days and by the time a post has been adminned, three or four topics have been posted. Early days and maybe a bit of settling in needs to be done.

        If Gort/Bud would like to lead me by the hand in how to go about things, then just shout but I must warn you, technology is not my bat.

          Fra, you wouldn’t be expected to know how it all works right now but you could easily learn. it isn’t difficult. I actually had to re-familiarise myself with the controls and it’s all very intuitive. Picking it up would be a piece of cake for you.

          That technical stuff aside, you could help by monitoring posts, coming up with lead articles, etc.

    Great to read from the previous page that a few from here made the funeral and even invoked our virtual presence there, said a prayer, had a drink in honour of Paul. I traveled towards Glasgow to attend a funeral last week but not Paul’s, and was deeply moved to see my cousin and his kids (and grandkids) celebrate and mourn the passing of a truly loved father and grandfather (the great grand-kids were too wee to fully understand). Have a great Christmas and New Year – if a blog picks up and continues I’m sure I’ll find it soon.

Let both blogs develop and people will vote with their feet and favour their preferred site . I feel our previous host would have liked it that way. Mick stepped up to the challenge when nobody else would and Johnboy started the process but has withdrawn. If you are out there JB your blog template wins on style by a country mile. I hope one of the new blogs will tempt a few of the more colourful posters out of retirement.           Mick, you seem to be using this site, Paul McConville’s, to drive traffic to yours, and in the same breath complain about budweiser using Paul’s creative page front.

          The layout used on http://continuingrandomthoughts.wordpress.com is one of the standard free themes they offer you when you set things up.

          The familiarity of that theme to regulars, I think, serves a useful purpose.

          Your theme, I think, has less broad appeal and undermines the perceived impartiality (and therefor the integrity) of the site.

          You seem to be also arguing that you deserve some sort of credit for setting yours up first when in actual fact most people, including johnbhoy and Budweiser, were respectfully waiting until after the funeral before making any moves. You were aware of that debate at the time and clearly ignored it, that’s on the record and I can provide links.

          Another thing you ignored was Monti’s explicit suggestion that you stand back and wait before jumping in head first. Again, I can provide links etc verifying that.

    It is sad to see what has become of this site. All the debate is about the merits of 2 new blogs while the drama surrounding the sevco shambles is to quote our media “off the radar”. Our former host would be sad to see this . Over in Mordor merlin is in overdrive posting at least daily at the behast of Jack Leggo is lashing out ,Sally is being sleekit ,the sons of struth are winding up for the AGM and the VB orc tribe are being nasty to everyone. Meanwhile on Random Thoughts we are calling each other names and making TSFM look like a fun site. If we cant sort out our differences it may be for the better if this site closes and everyone moves on ,sad as that may be.           Your good intentions are appreciated and your style would be suited to assist in running a blog.
          As i’ve said,it is very easy just to comment on someone else’s work but much more of a hassle to be in charge.The regulars should be able to self moderate and play nice out of respect to Paul.
          Mick seems to have lost the plot and i already knew that he had a darker side to his persona which pops out every now and then.I don’t think Mick drinks and you can ignore his rantings,he just got upset needlessly about his new baby blog.
          Don’t take on too much responsibility mate and don’t fall out with the boss lady!
          I have no idea regards the legalities of posting on Paul’s site.His family have enough to contend with.

            Utter nonsense. I haven’t attacked mick or his blog once. I simply suggested that it would be better to have one site that everybody used instead of two. He’s basically gone nuts at the suggestion, not because he disagrees but because he is looking at this from a very narrow perspective (the perspective of someone on a power trip).

            It was less than a week ago that you yourself, monti, advised mick to calm down and not to rush into anything. He completely ignored you.

            As we were all mourning and abstaining from any discussion of a new blog out of respect, mick jumped at the opportunity to snatch what he could. For some reason this is now being twisted into “he got there first”.

            Mick not only sees this as some sort of competition, he sees it in selfish and possessive terms — terms that make clear that it’s all about him, his blog, his power. Here and on his own site, he has already made clear he is the boss and threatened to block “huns” and others from posting. His resistance to the reasonable idea that the blogs should merge in itself is indicative.

            My continuing interest in all this, and I can say this now that I have handed over control to Budweiser, has been to help create a forum that the regulars here could use to discuss issues. It’s not like we are short of issues. Have a look at mick’s blog and tell me there are meaningful issues there.

            In amongst all his incoherent ramblings about the Irish and “huns” and his pro-republican standpoint, he decides to give us a recipe for cookies. Oddly enough, this was just about the only post I could comprehend.

      @Monti Good morning brother Monti what a wondrous place this Glasgow is. I spent the first hour in queens street station trying to fool the magic doors to no avail they always saw me coming. Then on to Marks and Spencers to buy some new underwear in case I get knocked down on the way to the AGM. Monti they have stairs that move up and down on their own and after another hour I was asked to leave for trying to run down the one going up.Not sure if Maggie was telling the truth about living here as I asked everyone I met where she lived and no one seemed to know her.         @Monti I see the Mick baiting is still going on with the cooper orc repeating a post about Fuds. As a former captain of the sevco debating team and a contestant on univesally challenged you would think he could have come up with a better riposte to getting sent to the naughty step. I dont know why Micks site is getting the abuse it is getting as it is funny and can be informative and will appeal to a different demographic to Buds effort. Cam seems to be busy on Buds new site so that should boost the comments section as he is prolific if nothing else. Anyway reports on the sevco AGM are leaking onto the net so must dash as mucho fun to be had later.

    OK I got it wrong sevco will not be tits up by Christmas and all I need to make my misery complete is old rearpipe turning up to gloat. The sons of struth have vanished from facebook and the rebels are in retreat. I wouldnt bet on a truth and reconcilliation committee being set up by the bash street bus boys anytime soon. Sandy Easdale is no Nelson Mandela. It is a pity the blog is the way it is as it would be nice to know the take on the AGM from our former neighbours of the orc persuasion. So it now looks like sevco tits up by Easter if they get past valentines day this time the romantic fools. Must dash I am making my darling wife a pot of brother Micks stonking leek and tattie soup.

      Stockbridge is the most hated Director at Ibrox & he polled DOUBLE either Murray in votes.

      That the Model was viable & he projected break even? A wee quote.

      Chief executive Wallace looked in command of his brief but he warned: “Cost structure is currently too high for the top division, never mind for the lower leagues.”

      Square that circle with Steerpike InDeNiall’s prediction of Celtic Supporters running scared in 2015 & TRFC winning one in every three leagues to qualify for Europe on a regular basis.

      There’s more but you get the drift.. Sevco right now are nearer achieving your prediction than his.

      There will be massive cost cutting or the game will be a bogey, or that old Sale & Lease back scenario will raise it’s head once more.

      PS go post a venison recipe on The Bampot site. 😉

          @Monti Evening brother Monti getting a touch of nostalgia wondreing what has happened to a lot of the old gang that used to lurk in this blog in the good old days. Cam flits in and out of retirement the cooper thingy managed to get banned from Micks new site so is spouting his strange brand of unionism and racism over on Buds new site, big chief Ben is back on the airwaves, MCFC has joined the radical wing of the annoracs liberation front or TSFM, Mick is now Mick the Blogmaster , Bud has a new blog with help from Mr Angry who has slipped out of the limelight to resurface from time to time to savage unwary posters. Wonder what happened to the other Gort,Joe ,OD,Maggie,Kerry girl and a few others. Hope never to come across a few from the Orc camp who were foul to Paul in real life. Micks new site is a safe haven as one look at the home page and the flag should be enough to repel Clarkeng,Willy Wonka and the rest of the orcs or even if they sneak in Mick is not slow to nuke them. I find it funny after Angry Gort mocking Mick for the Irish bias of his blog the first serious debate on his new site set up for bud is anti-Irish racism

            Absolutely spot on, Gortcho decries Mick’s blog out of hand & ridicules him out of hand for being too quick to create a blog, yet in the shadowy background, helps bud do exactly the same thing?
            I have nothing against either men although I think Gortch needs help with anger management!

              @monti you only miss something when it is gone. In my short time on Pauls blog 1 post in mod and it was an error as only 2 words . A post on Phils site hinting that Stockbridge may be a mason and it it is still in moderation while posts either side on the timeline for several hours are passed .Take a bow the late Paul McConville your blog was unique in the tolerance and broad mindedness you displayed. I like Micks site and Buds site will no doubt cover some of the issues but I think we all need to take a look at Pauls legacy and be a bit more tolerant. Anyway had a great time in Glasgow freezing my balls off at the AGM but this paying for sex carry on will never catch on here in the wild west. There was a small creature at the AGM wearing a rather fetching jacket that laced up the back ,a masonic apron and he seemed to be colouring in a GI Joe book using his feet. He reminds me of someone.

              Hector & Monti, it may take a little time for the rest to follow on but it’s going to be an extremely high standard to keep them there. I noticed on Buds site, an in depth exchange between Goldstein and Scotger where I had copied and pasted Goldsteins post from Paul’s blog.

              The banter is good and the posts can be quite intellectual. The others have gone their separate ways but in a little bit of time, the standards and paths which both blogs take, will determine their success. Personally I hope both blogs find their own little niche.

              There is only one guy to thank for Mick or Bud in taking up the Mod role. Without big Paul, it wouldn’t have happened. Hail hail my trusted comrades.

    @Fra the only thing wrong with buds new site is the recipes. I have followed the site , saw the debate you talk about read some of the crap posted by one of the orcs but after the way Mick was treated do not feel comfortable joining in at the moment. This is not having a go but think the way Mick was treated was poor and would like to think our late host would agree. Anyway the orcs are in a mess once the recipes on Bampots take off the price of venison will go through the roof and I will be so well off I may be able to leave this pile of rocks for the big city more than once a year. I would love to go back to Glasgow and the magic doors at Queens Street station and one day visit the city of fife where my pen pal Monti lives.

    This morning on a walk on the beach I found a message in an IRN BRu bottle which is a first for me. It was written in a childlike hand none of that fancy joined up writing and it seems to be a cry for help. “pleese help me ol my pals ar gone and I am on my own. i used to hav frends on the interweb but no won likes me anymor. luv cam aged 47 and a haff. I passed the note to Childline and hope the poor tortued individual is OK. Must dash the Pishometer is going off the scale LOCK UP YOUR GOATS! THIS IS NOT A DRILL!!!!!!

Bill McMurdo is worried about the nasty sevconians calling for Lee Harvey Oswald to sort out Stockbridge , the bus boys are whinging to Police Scotland about threats to burn McGills buses .At this rate Craig whyte will be claiming he owns Ibrox and Rangers will be over 2 years old.

    Well a sad day as it looks like Pauls blog has come to the end of the line. Two new blogs have sprung up but neither even combined can replace what the original Random Thoughts became .Both new blogs have their merits and will with luck and goodwill develop and keep some of Pauls bampots together. Phils blog and Mc murdos blog are almost cults with the personality of the host the main theme and as a result moderated to death. TSFM is a good site heavily moderated but informative clever but too technical and a bit serious. For intentional humour Jabba the Agnivore blog is a side splitter and then we have leggoland not meant to be funny but comedy gold .If you combine the strong points of all of the above you still do not come close to the blog that the late Paul Mc Conville put together and with a bit of luck some of the tolerance good grace and humility he demonstrated will rub off on those that got to take part. RIP Paul never got to meet you but that is my loss.

      If this is the end of the blog, I would just like to say a heartfelt thanks to each and everyone of the contributors. It began to take up more of my time than I intended but I enjoyed around 99% of all posts.

      I hope you all have a Happy and safe Christmas and anybody with little ones, give them a special hug. I wish the McConville family happiness and blessings as they will forever be in my prayers.

      To the memory of Paul. I will cherish the moments I spent reading, answering and arguing with all and sundry. It was a blast and that was all down to one man. May you rest with the Angels Paul and I for one will always hold your memory in a special place.

    Not sure if this will work but it is one year to the day since Paul left us . Our thoughts and prayers are with his friends and family at this time. RIP Paul and if any of the old gang are about I hope the last year has been kind to you.
